Access to Airway World is subject to the following Terms, Conditions, and Notices which are for purposes of protecting the security, privacy, and integrity of the users, visitors and exhibitors (hereinafter collectively referred to as “visitors”) using Airway World. These terms, conditions, and notices apply to each and every visitor to Airway World.
Airway World is available to visitors conditioned upon acceptance of all terms, conditions, and notices contained herein, and the use of Airway World by any such visitor constitutes acceptance of all such terms, conditions, and notices. Airway Management Education Center, LLC (hereinafter “AMEC,” or “we,” or “us”) reserves the right to modify or update any and all of the terms, conditions, and notices at its discretion without prior notice to visitors. AMEC reserves the right to suspend or terminate Airway World at any time without notice.
Airway World supports the dissemination of accurate and reliable information related to airway management. All images and content contained in Airway World, unless otherwise specified, are the property of AMEC and are subject to, and protected by, the copyright laws of the United States. Any commercial use, reproduction, or re-publishing of any AMEC Content without prior written consent from AMEC, is strictly prohibited. Notwithstanding the foregoing, Airway World content may be used without the prior consent of AMEC, when such use is for educational purposes as part of a program of instruction or training under the auspices of an accredited educational institution. No such use shall confer upon any user, any ownership rights, title, interest or the authority to approve any further or subsequent use for any such images or content. Any and all of the aforementioned uses of any images and content contained in Airway World must contain in readable type the expression: “Adapted from Airway World, www.airwayworld.com.”
Any information posted on Airway World by any party will be available to all visitors, and any such posting by any party hereby agrees to such use by AMEC. This content includes but is not limited to comments made in one-to-one, group, moderated chat sessions or webinars. IN ADDITION TO ANY OTHER DISCLAIMER CONTAINED HEREIN, AMEC HEREBY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT THE INFORMATION DISPLAYED WILL BE ACCURATE, ERROR-FREE, OR INOFFENSIVE AT ALL TIMES.
All visitors must agree to use Airway World only for the purposes for which it was intended. No visitors shall use or attempt to use Airway World for any unlawful purpose, or for any purpose prohibited by the terms, conditions, and notices set forth herein. In addition, no visitors must use or attempt to use Airway World in a way that could damage, disable, overburden, or impair the server, or the network(s) connected to the server, or interfere with any other visitor’s use and enjoyment of Airway World. No visitors must gain or attempt to gain unauthorized access to any information not made generally available through Airway World including, without limitation, hacking, data mining, spamming, spy ware, phishing or pharming, copyright or trademark infringement, defamation, slander, or harassment, unlawful or fraudulent advertising or solicitation, each of which are strictly prohibited.
The information available at Airway World is presented for informative purposes and as a resource for health care professionals, and is not intended to constitute medical advice. Information, data, advice or any other information obtained by any visitor from Airway World should not be relied upon for any medical decisions or related purposes. AMEC SHALL NOT BE LIABLE, WHETHER IN TORT, CONTRACT, OR STRICT LIABILITY, FOR ANY ACTUAL DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ALLEGEDLY ARISING OUT OF THE USE OF, OR RELIANCE UPON, ANY PRODUCT, SERVICE, OR INFORMATION, CONTAINED IN, OR PURCHASED FROM Airway World, ANY EXIBITOR THEREOF, OR AMEC.
Each visitor hereby agrees to indemnify, save, and hold harmless AMEC and its representatives, agents, and employees, as well as exhibitors of Airway World, and to defend against any and all claims, liabilities, damages, costs, (including reasonable attorney’s fees) to the full extent provided by law caused by, arising out of, or resulting from, wholly or in part, your posts, unauthorized or authorized use of material obtained through Airway World, or from your breach of the terms, conditions, and notices, Federal, or state law.
These Terms and Conditions are governed by Federal law and the law of the state of Connecticut, without regard to its conflicts of law provisions. By agreeing to the terms, conditions, and notices contained herein, all visitors agree to the exclusive jurisdiction and venue of state and Federal courts in Springfield, Massachusetts.
If any provision of these terms, conditions, and notices is deemed invalid by a court of law with jurisdiction over the matter, then the invalid portion will be superseded by a valid provision bearing the intent of the original provision, and the remaining provisions will remain in effect.
This agreement represents the entire agreement between visitors and AMEC with respect to Airway World, and replaces all prior or contemporaneous agreements, terms, conditions, and notices.
AMEC respects visitors’ right to privacy, and is committed to safeguarding the information collected. This Collection & Use of Information Notice explains how AMEC collects, utilizes, discloses, and protects visitor information in connection with the use of Airway World. This Collection & Use of Information Notice extends only to information collected through Airway World. AMEC reserves the right to update or revise this Collection & Use of Information Notice at any time. If a significant change is made, AMEC will disclose the modification. Visitors’ use of Airway World after any published change signifies consent to the revised Notice.
AMEC may from time to time may invite visitors to provide information about themselves. This information may include, but is not limited to name, address, email address, specialty, title. In addition, AMEC collects non-personal, anonymous information (e.g., number of visits, number of visitors, videos viewed, documents downloaded, referral source, etc.) all of which constitute standard website analytics.
AMEC uses the information collected to continuously improve Airway World and to customize our offerings. In addition, we utilize contact information provided by visitors to communicate directly with them.
AMEC may disclose Information under the following circumstances: (i) To enforce the terms, conditions, and notices of Airway World; (ii) In the good faith belief that disclosure is required by Federal and/or state law; (iii) If reasonably necessary to conform to legal process, respond to subpoenas or court orders, or defend against any claims brought against AMEC; (iv) To protect the rights, property, or personal safety of Airway World visitors or the public; and (v) In the event of a sale or acquisition, merger, or transfer of AMEC assets if permitted by and completed in accordance with applicable law.
Airway World may contain links to other websites which are not under the control of AMEC. As such, AMEC is not responsible for the content or images displayed on any third party website. AMEC provides links to other websites only as a convenience, and the inclusion of such link does not imply that AMEC in any way supports the website or its content or images.
